SBD 7.1, 7.2 and 7.3: the contract forms
SBD 1 tells you the successful bidder will fill in and sign a written contract form, SBD 7. There are three versions, and some tender packs ask for Part 1 to be signed with the bid. Here is what you are signing.

Each form is completed in duplicate and both copies are signed in the original, so the bidder and the buyer each keep an originally signed contract.
Part 1: what you undertake
- You undertake to supply the goods, works or services described in the bidding documents (or, on SBD 7.3, to lease the property or buy the goods or services), under the bid number, at the prices quoted, and your offer stays binding for the validity period the bid states, counted from the closing time (the closing date on SBD 7.2).
- The agreement includes the bidding documents: the invitation to bid, proof of tax compliance status, pricing schedules, technical specifications (on SBD 7.2, the filled-in task directive or proposal), the preference claim form, the bidder's disclosure and special conditions, plus the General Conditions of Contract.
- You confirm that your prices cover everything specified and any pricing or calculation mistake is at your own risk.
- You accept responsibility as the principal for performing the contract, declare that you took part in no collusive practices, and confirm that you are authorised to sign. On SBD 7.3 you also undertake to pay for the leased property, goods or services.
Two witnesses sign next to you. The form has a separate date line for you and for the witnesses.
Part 2: the buyer's acceptance
The buyer's authorised official accepts the bid by reference number and date. On SBD 7.1 and 7.2 the official says an official order will follow and undertakes to pay within 30 days of receiving an invoice (on SBD 7.1, an invoice with the delivery note). On SBD 7.3 the institution undertakes to make the leased property, goods or services available. The table records the price including all applicable taxes, the total preference points claimed and the points for each specific goal, with the brand and delivery period on SBD 7.1 and the completion date on SBD 7.2. Part 2 is also witnessed and stamped.
What to check
- SBD 7 has no validity box of its own: it binds you to the validity period the bid states. Check that the period you give on the pricing schedule (SBD 3) is at least that long.
- The bid number and institution name are filled in, and you sign Part 1 only, never Part 2.
- Both witnesses sign, and the dates are in the right boxes.
- The preference points recorded later in Part 2 match what you claimed on SBD 6.1.
